First Bristol Federal Credit Union Home Banking Terms of Use.

I. Introduction

This Home Banking Agreement for accessing your First Bristol Federal Credit Union accounts through Home Banking explains the terms and conditions governing Home Banking and its ancillary on-line services; Bill Payment, Mobile Banking and e-Statements. Additional terms and conditions may apply to each ancillary on-line service and are disclosed in each respective Addendum Agreement listed below.  By using the Home Banking Services, you agree to the terms and conditions of this Agreement and Addendum Agreements and acknowledge your receipt and understanding of this Agreement and Addendum Agreements. This Agreement and its Addendum Agreements will be governed by and interpreted in accordance with Federal law and regulation, and to the extent there is no applicable Federal law or regulation, by the laws of the State of Connecticut. The terms "we," "us," "our," "First Bristol Federal Credit Union," and "Credit Union" refer to First Bristol Federal Credit Union. "You" refers to each signer on an account. The term "business days" means Monday – Wednesday and Friday from 9:00am to 4:30 pm; Thursday from 9:00 am to 5:30pm. Saturday, Sunday and Federal holidays are not included in business days. (If you contact us outside of our normal business hours, we may consider your communications as having been made during the business day immediately following the day you actually contacted us.)

Home Banking and its ancillary on-line services can be used to access First Bristol Federal Credit Union accounts. Each of your accounts at the Credit Union are also governed by the Membership and Account Agreement, all other applicable account disclosures, the Credit Union's rules and regulations, the rules and regulations of any funds transfer system to which the Credit Union belongs, and to any future changes to such. We agree to be governed by them also.

II. Accessing your Credit Union Accounts through Home Banking

A.  Benefits of Using Home Banking    

With Home Banking, you can manage your accounts from your personal computer. You can use Home Banking to:

  •  View account balances and review transaction history.
  • Transfer money between accounts. (Within the limitations of the Membership Account Agreement and other applicable disclosures.)
  • View e-Statements.
  • View check images. 
  •  Communicate directly with the Credit Union through Messaging.

You can also access FBFCU’s other ancillary on-online services as follows:

With Bill Payment, you can manage bill paying from your Checking Account(s) using a personal computer or mobile device.

 You can use Bill Payment to:

  •  Pay bills.
  • Pay a person.
  • Schedule recurring payments to be made automatically.
  • Transfer funds to an account at another financial institution.

With Mobile Banking, you can enjoy banking from your mobile device.

 You can use Mobile Banking to:

  • View account balances and review transaction history.

  •  To pay bills, schedule automatic recurring payments, or send money to another financial institution.
  • To get instant balances on your mobile device.
  •  View check images. 
  • Make person-to-person payments and receive payments using Popmoney.

B.  Requirements

To access Home Banking and its ancillary on-line services, you represent that you are an account owner or an authorized user on any account you access; that your accounts are in good standing; and that you have a Home Banking User ID and password. You agree to follow any instructions provide in connection with your use of Home Banking and its ancillary on-line services. You are responsible for the proper operation of any personal computer or mobile device and any Internet service or cellular service used to access Home Banking and its ancillary on-line services. You are responsible for any charges, expenses, or costs you may incur as a result of use or misuse of your personal computer, mobile device, Internet service or cellular data service.

C.  Home Banking Messaging

Sending a message through Home Banking is a way to communicate with the Credit Union. Messaging is provided to you to ask general questions about your account(s) and provide general feedback. Messaging is accessible after you sign on with your User ID and password to Home Banking. You should never include account numbers, your social security number, or any information that is highly confidential in your message. All communications sent to us through Home Banking are our property.

III. Terms and Conditions

A. Your Home Banking User Name and Password

You will select a User Name and Password for Home Banking. We strongly recommend that you do not use your name or account number for either one of these. Your User Name and Password will give you access to your Credit Union accounts through Home Banking and its ancillary on-line services. You will be required to change your password regularly. We reserve the right to require additional login procedures in order to authenticate the user. The Credit Union will act on instructions received under your password. You agree to keep your password secure by memorizing it or keeping it in a safe place, not disclosing it to any third party other than those to whom you provide your express authorization and you will not record or display your password in such a manner that it will be accessible by unauthorized third parties. You agree not to leave your personal computer or mobile device unattended while logged into Home Banking or any of its ancillary on-line services, and you will promptly log off each time you finish using Home Banking or any of its ancillary on-line services. You understand that any person having access to your User Name and/or Password will be able to access Home Banking or any of its ancillary on-line services, and perform all transactions allowable through these services. You agree that use of your User Name and/or Password by you, any other applicant, any party to any of your accounts that may be accessed by your User Name and/or Password, anyone you permit or authorize to use your User Name and/or Password, and anyone to whom you disclose your User Name and/or Password or give access to your User Name and/or Password is deemed an authorized user for which you will be liable. If you authorize another person to use your User Name and/or Password in any manner, your authorization is considered unlimited in amount and manner. You are responsible for any transactions made by any such person until you specifically revoke such authority by notifying the Credit Union.

You are responsible for reporting the loss, theft, or compromise of your User name and/or Password to us as soon as possible after you learn of it or suspect that unauthorized use has or may occur using one of the methods described later in this Agreement. For your security, we may restrict access to Home Banking or any of its ancillary on-line services without notice if we suspect fraudulent activity.

B. Interruption of Service

If you should experience an interruption while conducting a transaction using Home Banking or any of its ancillary on-line services, you should immediately logout of Home Banking or the applicable on-line service and login again to verify if your transaction has been completed. If you cannot login to Home Banking or the applicable ancillary on-line service, you agree to contact the Credit Union promptly to determine if the transaction has been completed. In order to avoid duplicate transactions, you agree not to re-request a transaction performed during an interrupted session.

C.  Fees

There are no monthly or transaction fees for using Home Banking, Mobile Banking, Bill Payment or e-Statements. Other fees may apply as disclosed in the Truth in Savings Disclosure. Also note that fees may be assessed by your Internet or cellular data service provider.

D. Changes to Charges, Fees or Other Terms

We reserve the right to change the fees described in this Agreement, Addendum Agreements, the Truth in Savings Disclosure or other related disclosures. If we do make any changes to such fees we will notify you as required by applicable law. You may choose to accept or decline changes by continuing or discontinuing the accounts or services to which these changes relate.

E. Overdrafts: Order of Payments, Transfers, Other Withdrawals

You agree that your use of Home Banking and any of its ancillary on-line services shall be subject to our overdraft (NSF) policies and the overdraft provisions set forth in the Membership and Account Agreement, Member Privilege Agreement and Truth-in-Savings Disclosure. If there are insufficient funds available in your account or from any other form of overdraft protection, we may not process a transaction you have requested. In such event, you understand and agree that you will be responsible for making alternate arrangements for the transaction. We are under no obligation to process a transaction for which sufficient funds are not available. We are not required to notify you in such event and we will charge any overdraft fee as described in the Truth in Savings disclosure. In the event we do decide to approve a transaction for which sufficient funds are not available, we will charge the total cost of the transaction to you, including any overdraft fee as described in the Truth in Savings disclosure.

You also understand that if your account has insufficient funds to perform all electronic funds transfers (ATM withdrawals, pre-authorized transactions and Bill Payment transfers, etc.) that you have requested for a given business day, then:

  •  Certain electronic funds transfers involving currency disbursement, like ATM withdrawals, will have priority, and
  •  The electronic funds transfers initiated through Bill Payment may result in an overdraft of your account and may, at the Credit Union’s discretion, be cancelled.

F. Hours of Accessibility

You can access your Credit Union accounts through Home Banking and any of its ancillary on-line services seven days a week, 24 hours a day. However, at certain times, some or all of Home Banking or any of its ancillary on-line services may not be available due to system maintenance. You will be notified when this occurs.

Batch processing is conducted each day at 7:30pm. All transfers initiated through Home Banking or Mobile Banking before 6:30pm on a business day will have a posting date effective that day. All transfers initiated after batch processing on a business day or on a Saturday, Sunday or Credit Union holiday will have a posting date effective the next business day.

G. Compliance with Law

You may not use Home Banking or any of its ancillary on-line services in any way that violates applicable law. You may not use Home Banking or any of its ancillary on-line services from any location where the content provided by Home Banking or any of its ancillary on-line services or use of the Home Banking or any of its ancillary on-line services is illegal, and you assume all responsibility and risk of loss if you do so.

H. Your Right to Receive Documentation of Transactions

All transactions performed on your accounts using Home Banking or any of its ancillary on-line services will be recorded on your periodic statement. You will receive a statement monthly for Checking accounts and at a minimum quarterly for all other Accounts.

I. New Services

The Credit Union may, from time to time, introduce new services available through Home Banking or one of its ancillary on-line services. We will notify you of any new services. By using these services when they become available, you agree to be bound by any terms and conditions communicated to you concerning these services.

J. No Warranty

Home Banking and its ancillary on-line services are provided “as is” and as “available” without any warranty of any kind. We do not warrant that Home Banking or any of its ancillary on-line services will be uninterrupted or error-free. Neither the Credit Union nor any of its service providers makes any warranty on any equipment, hardware, software, or the services, or with respect to your internet service provider, either express or implied, including without limitation, any warranty of merchantability or fitness for a particular purpose, no infringement, or performance unless disclaiming such warranty is prohibited by applicable law.

K. Other Liability

Except as specifically provided in this Agreement and the Addendum Agreements or where the law requires a different standard, you agree that neither we nor the service providers shall be responsible for any direct or indirect economic or other loss, property damage or bodily injury, whether caused by the equipment, software, the Credit Union, by Internet browser providers, by Internet access providers, mobile device providers, cellular data providers or by an agent or subcontractor of any of the foregoing.

L. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold the Credit Union, its service providers, and their respective directors, officers, employees and agents harmless from and against all costs, claims, damages, liabilities, and expenses (including attorney fees) arising out of or related to your access to or use of Home Banking or any of its ancillary on-line services or if you violate this Agreement.

IV. General Terms And Conditions

A. Disclosure of Account Information

We will disclose information to third parties about your accounts or the transactions you make:

  •  As necessary to complete transfers.
  • To verify the existence of sufficient funds to cover specific transactions upon the request of a third party, such as a credit bureau or merchant.
  • If your account is eligible for emergency cash and/or emergency card replacement services and you request such services, you agree that we may provide personal information about you and your account that is necessary to provide you with the requested service(s).
  • To comply with government agency or court orders.
  • If you give us your written permission.    

In addition, the Credit Union routinely informs a credit bureau when accounts are closed by the Credit Union because they were not handled properly. The Credit Union may also seek information about you from others, such as a credit bureau, in connection with the opening or maintaining of your account. You authorize these transfers of information.

B.  Joint Accounts

If any of your accounts accessed under this Agreement or any of its Addendum Agreements are joint accounts, all joint owners, including any authorized users, shall be bound by this Agreement and all of its Addendum Agreements and, alone and together, shall be responsible for all transactions to or from any Credit Union accounts as provided in this Agreement or any of its Addendum Agreements. Each joint account owner, without the consent of any other account owner, may, and is hereby authorized by every other joint account owner, make any transaction permitted under this Agreement and all of its Addendum Agreements. Each joint account owner is authorized to act for the other account owners, and the Credit Union may accept orders and instructions regarding any transaction on any account from any joint account owner including to disclose information about the account or transfers to third parties or to cancel Home Banking or any of its ancillary on-line services providing access to your accounts.

C. Limitations On Transferring Funds

For Regular Share, Money Market, Vacation Club, Christmas Club, Miscellaneous Share and Summer Club accounts, you may make no more than six (6) preauthorized, automatic, Automated Clearing House (ACH), bill payment system, telephone, audio response, fax or Home/ Mobile Banking withdrawals/transfers to another account of yours or to a third party during any calendar month. We may refuse or reverse a transfer that exceeds these limitations and may assess fees against, suspend or close your account. For the IRA Accumulation account, you may not make any preauthorized, automatic, Automated Clearing House (ACH), bill payment system, telephone, audio response, fax or Home /Mobile Banking withdrawals/transfers from your account at any time. For Checking accounts, these limitations do not apply.  If a hold has been placed on deposits made to an account from which you wish to transfer funds, you cannot transfer the portion of the funds held until the hold expires.

D. Evidence of Transactions.

You agree that a photographic record or copy of any transaction involving your account shall be evidence establishing your liability in any legal action involving you and us.

E. Internet and Wireless Security

Email and other wireless communications may not be confidential or secure. Accordingly, you agree to not disclose account information (i.e. account numbers, passwords, sign-on ids, Social Security numbers etc.) in an email to the Credit Union. You agree not to provide your personal information or account information to any person or through any wireless network you do not know or whose identity you cannot verify. If you do, you assume all risks, subject to applicable law. We will never contact you by telephone, text messaging, email, or otherwise and ask you to provide us your personal or account information, including your Social Security number, user name, password, and account numbers. You agree to remain vigilant for phishing and other fraudulent scams and notify us promptly if you become aware of or suspect fraudulent activity involving your identity, accounts, or the Credit Union. You agree to notify us if you change your telephone number, email address or other contact information.

All communications sent to us are our property.

F. Credit Union Liability for Failure to Make Transfers

If we do not complete a transfer to or from your Credit Union account on time or in the correct amount according to our Agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  •  If, through no fault of ours, there is not enough money in your accounts to complete the transaction, or if any funds in your accounts necessary to complete the transaction are held as uncollected funds pursuant to our Funds Availability Policy Disclosure.
  •  If a legal order directs us to prohibit withdrawals from the account. 
  •  If your account is closed or if it has been frozen. 
  •  If the transfer would cause your balance to go over the credit limit for any credit arrangement set up to cover overdrafts. 
  •  If you, or anyone you allow, commits any fraud or violates any law or regulation.  
  •  If any electronic terminal, telecommunication device or any part of the electronic fund transfer system is not working properly.  
  •  If the transaction is prevented by policies, rules, or limitations imposed from time to time, such as minimum balance requirements or verification and collection of deposits.
  •  If you have not properly followed the instructions for using Home Banking any applicable ancillary on-line services
  • If circumstances beyond our control (such as fire, flood or improper transmission or handling of payments by a third party) prevent the transfer, despite reasonable precautions taken by us. 
  •  A direct deposit/payroll deduction was not sent to us.
  •  If it is the result of your willful or negligent use of your Home Banking User Name and/or Password.
  •  If the fault is yours.
  •  If other statements in this Agreement or any of its Addendum Agreements state so.
  •  You do not give your correct Home Banking User Name and/or Password or other identifying information.
  •  Your Home Banking or any of its ancillary on-line services access has been cancelled or deactivated.

There may be other reasons under federal or state law why we will not be liable.

G. Questions or Error Corrections on Home Banking, Mobile Banking or Bill Payment Transactions

In case of questions or errors about electronic transfers involving your account, telephone us at the following number or fax us at the following number or send us a written notice to the following address as soon as you can. We must here from you no later than 60 days after we sent the first statement on which the problem appears.

  •  Tell us your name and account number
  •  Describe the error or the transaction you are unsure about, and explain why you believe it is in error or why you need more information. 
  •  Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your compliant or question in writing within ten (10) business days.

We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days (or 90 days if the error applies to a point-of-sale transaction, a foreign-initiated transaction or for a new account), to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days (20 days for a new account) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days (20 days for a new account), we will not credit your account.

We will tell you the results within three (3) business days after we finish our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documentation that we used in our investigation.

If the error involves an unauthorized VISA transaction other than a cash disbursement at an ATM, we will credit your account within five (5) business days unless we determine that the circumstances warrant a delay, in which case you will receive credit within ten (10) business days.

H. Unauthorized Transactions on Your Credit Union Accounts

Notify us immediately if you believe another person has improperly obtained your password. Also notify us if someone has transferred or may transfer money from your account without your permission, or if you suspect any fraudulent activity on your account. Telephoning us is the best way of keeping your possible losses down.

If your password has been compromised and you tell us within two (2) business days after you learn of the loss or theft, you can lose no more than $50 if someone used your password without your permission to access a Credit Union deposit account. If you do NOT tell us within two (2) business days after you learn of the loss or theft, and we could have stopped someone from taking money without your permission had you told us, you could lose as much as $500.

If your statement shows withdrawals, transfers or purchases that you did not make or authorize, please notify us immediately. If you do notify us within (60) days after the paper statement was mailed to you, and we could have stopped someone from taking money if you had told us in time, you may not get back any money lost after the (60) days. If extenuating circumstances, such as a long trip or hospital stay, kept you from telling us, the time periods in this section may be extended.

If you believe your Home Banking password has been compromised or that someone has transferred or may transfer money from you accounts without your permission.

I.Non-Enforcement of Our Rights.

We can choose not to enforce or to delay the enforcement of any of our rights under this Agreement or and of its Addendum Agreements, or as allowed by law without losing any of our rights in the future.

J.Amendments.

We may add to, change, or delete the terms of this Agreement or any of its Addendum Agreements at any time subject to such notice as may be required by applicable law. Your use of this service following receipt of any such notice constitutes your acceptance of any such change.

K. Preventing Misuse of Your Account

Your role is extremely important in the prevention of any wrongful use of your account. You must promptly examine your statement upon receipt. If you find that your records and ours disagree, you must immediately contact the Credit Union using one of the methods described earlier in this Agreement.

In addition to protecting your account information, you should also take precautions to protect your personal identification information, such as your driver's license, Social Security Number, etc. This information by itself or together with information on your account may allow unauthorized access to your account(s). It is your responsibility to protect personal information with the same level of care that you protect your account information.

The password that is used to gain access to Home Banking and its ancillary on-line services should also be kept confidential. You will be required to change your Home Banking password regularly. It is recommended that you memorize your Home Banking password and do not write it down.

You are responsible for keeping your password, account numbers and other account data confidential. Only reveal your personal information to legitimate entities for purposes you authorize. If you believe that your Home Banking password may have been lost or stolen, or that someone has transferred or may transfer money from your account without your permission, you must immediately contact the Credit Union using one of the methods described earlier in this Agreement.

V. Canceling This Agreement.

The Credit Union reserves the right to terminate this Agreement or any of its Addendum Agreements and your access to Home Banking or any of its ancillary on-line services, in whole or in part, at any time without prior notice.

If more than one person is authorized to conduct transactions from your accounts using Home Banking or any of its ancillary on-line services, we cannot stop that person from making those transactions from your accounts unless we cancel Home Banking and any applicable ancillary on-line services.

If the account is a joint account, any one of the account owners may ask us to terminate this Agreement, any of its Addendum Agreements or cancel Home Banking or any of its ancillary on-line services.  Any one of the account owners may ask us to take any other action in connection with the account.  We can do this without prior or subsequent notice to or approval by the other account owners.

You can cancel this Agreement or any of its Addendum Agreements by asking us to cancel. You can also cancel this Agreement or any of its Addendum Agreements by closing your accounts at the Credit Union. You can also at any time remove Home Banking or any of its ancillary on-line services from your accounts.  You agree to give us 3 business days to cancel this Agreement or any of its Addendum Agreements after you give us notice.  

Even if this Agreement or any of the Addendum Agreements are canceled, or end, you understand that you will continue to be responsible for paying us whatever you owe us at that time under this Agreement or any of its Addendum Agreements.
